Subclass 010 Bridging Visa A (BVA)

Bridging visa A or BVA allows a person to stay in Australia while their substantive visa application is being processed, which they lodged while holding a substantive visa.

An applicant will need to lodge a separate BVA in the following circumstances:

  • If the substantive visa application doesn’t constitute an application for a BVA.
  • If the applicant was granted a BVA or BVB, which has ceased, but they meet requirements for another BVA.
  • If they are seeking another BVA without work restrictions.
  • If they have lodged a judicial review.

Cost of BVA

Applying BVA is free of cost.

Eligibility for BVA

  • The applicant applying for a BVA must hold a substantive Visa.
  • The Applicant must be in Australia at the time of the lodgement of BVA.
  • Applicant must have made a valid application for a substantive visa that has not been decided or an application for a judicial review has been made within the prescribed time which has not been decided.
  • BVA must be lodged in the prescribed timeframe.
  • There are no age criteria for BVA.
  • Applicant must meet character criterion.

Travel on BVA

An applicant holding a BVA cannot return to Australia if they don’t have a Bridging Visa (BVB) granted.

Conditions on BVA

A BVA may come with various conditions depending on the circumstances. Some of the conditions which may be imposed on a BVA are as follows:

Condition 8101 – No work

Condition 8102 – Not work other than in relation to study or training

Condition 8103 – No paid work

Condition 8104 – Work limitation

Condition 8105 – Work limitation

Condition 8107 – Work limitation

Condition 8108 – Work limitation

Condition 8111 – Work limitation

Condition 8112 – Must not engage in work that might otherwise be carried out by an Australian citizen or permanent resident

Condition 8114 – Superyacht crew

Condition 8115 – Limited activities

Condition 8303 – Not be disruptive

Condition 8501 – Maintain adequate health insurance

Condition 8539 – Live, study, and work in a specified area

Condition 8547 – Not work for one employer for more than six months

Condition 8549 – Live, work, and study in a designated area

Condition 8607 – Must only work in the nominated occupation

Subclass 020 Bridging Visa B (BVB)

Bridging visa B is required for travel outside Australia if an applicant’s substantive visa application is being processed. Applicant should not apply for a BVB with less than two weeks of travel date or more than three months before travel date. A BVB application can be lodged online.

Cost of BVB

Applying for BVB is going to cost an applicant AUD 180.

Eligibility for BVB

  • The applicant applying for a BVB must have held a substantive Visa.
  • At the time of the Bridging Visa B (BVB) application, an applicant must hold a BVA or a BVB.
  • Applicant must have made a valid application for a substantive visa that has not been decided or an application for a judicial review has been made within the prescribed time which has not been decided.
  • You must apply for review within the prescribed timeframes.
  • The applicant must provide a substantial reason to be granted a BVB. Some reasons are family emergencies like close relatives passing away or being sick. Documentation is required to back up the reason.
  • Applicant can be of any age to apply for BVB.
  • Applicant must meet the character criterion.

Subclass 030 Bridging Visa C (BVC)

If an applicant applies for a substantive visa while holding a bridging visa, they are, in most cases, granted a BVC instead of BVA. BVA allows applicants to stay in Australia while their substantive visa is processed.

Applying BVC is free of cost.

Eligibility for BVC

  • The applicant must have been in Australia during BVC lodgement.
  • An applicant for a BVC visa must not hold a BE or have held a BE since they last held a substantive visa.
  • Applicant must have lodged a substantive visa without holding a substantive visa.
  • Applicant must have made a valid application for a substantive visa that has not been decided, or an application for a judicial review has been made within the prescribed time, which has not been decided. They must not have previously held a BVC concerning the substantive visa application.
  • Applicant can be of any age to apply for BVC.
  • Applicant must meet the character criterion.

Travel on BVC

A BVC visa holder cannot apply for a Bridging Visa B (BVB) visa to travel outside Australia. Once they exit Australia, they will need a substantive visa to travel back to Australia.

Conditions on BVC

The following conditions may be imposed on a BVC.

8101: No Work. A person may apply for a new BVC seeking working rights if they can prove they are going through financial hardship or their family will need government help. Or they have compelling reasons to work in Australia due to illness or injury. Or you or your family members cannot return home due to reasons beyond your control or have no choice but to work in Australia.

8303: Not be disruptive.

8501: Maintain adequate health insurance.

Subclass 050 Bridging Visa E (BVE)

BVE is commonly lodged to make a person lawful until they can make arrangements to leave Australia.

Cost of BVE Subclass 050

Applying BVE is free of cost.

Eligibility for BVE

An applicant lodging a BVE subclass 050 application must be one of the following:

  • An Unlawful Citizen
  • The holder of a BE subclass 050
  • Holder of a BVD subclass 041

AND one of the following must apply:

  • Must be making arrangements to depart Australia.
  • Must be applying for a substantive visa.
  • Must be applying for a judicial or merits review.
  • No age criteria apply, but the application for BE for a minor must be accompanied by a parent/guardian.
  • Must meet character requirements.
  • Previous refusal or visa cancellation may affect the visa grant.

Conditions on BVE Subclass 050

A BVE may come with various conditions depending on the circumstances. Some of the conditions which may be imposed on a BVE are as follows:

8104 – Work limitation

8116 – Specified work only

Subclass 051 Bridging Visa E (BVE)

BE subclass 051 lets you stay in Australia while your protection visa application is being decided.

Applying BVE is free of cost.

Eligibility for BVE

A person applying for subclass 051 BE must have been refused immigration clearance or bypassed immigration clearance, and hat that should have come to the notice of the Department within 45 days, and all of the following must apply:

  • The applicant must have made an application for a protection visa.
  • Applicant must be in immigration detention.
  • Must meet the requirements of age, health, and nomination or should meet the requirements of a further BVE 051 visa.
  • Must meet health requirements.
  • Must meet character requirements.
  • Can be of any age.
