Changes to Visa Conditions 8107, 8607, and 8608

As per the Australian Government’s Migration Strategy, visa conditions 8107, 8607, and 8608 will be revised on July 1, 2024. The purpose of these changes is to address worker exploitation and improve productivity.

Improvements for Temporary Migrants

The changes will help temporary migrants who have the following visas:

  • Temporary Work (Skilled) visa (subclass 457)
  • Temporary Skill Shortage visa (subclass 482)
  • Skilled Employer Sponsored Regional (provisional) visa (subclass 494).

Flexibility for Visa Holders

Visa Holders who stop working with their sponsoring employer will have more time to find a new sponsor, apply for a different visa or arrange to depart Australia. They will have:

  • Up to 180 days at a time, or
  • A maximum of 365 days in total across the entire visa grant period

During this time, visa holders can work for other employers, including in occupations not listed in their approved sponsorship nomination, assuring they can support themselves while they look for a new sponsor.

Important Conditions

  • Visa holders cannot work for another employer unless they have stopped working with their sponsoring employer, unless exempt.
  • They must remain in their nominated occupation while working for their existing sponsor.
  • Sponsors should inform the department within 28 days of any modifications, such as discontinuing sponsorship or a visa holder’s resignation.

Visa holders are prohibited from performing work inconsistent with any necessary license or registration for their selected occupation, including any specific conditions or requirements.

Applicability

These modifications apply to existing visa holders and those granted a visa on or after July 1, 2024. Any time a visa holder stops working for their sponsor before this date, it will not count towards the new period.
