The Australian government has announced new changes for 482 and 186 Employer Nomination Scheme visas which are scheduled to begin on 25th November 2023. This is to bring more consistency and certainty for employers and TSS visa holders.

What is changing for the TSS 482 visa and 186 TRT stream visas?

CURRENT: Under the current system, subclass 482 Temporary Skill Shortage short-stream visa holders have limitations on the number of applications they can lodge onshore in Australia. This causes inconvenience to visa holders and employers and is a costly process. According to the current process, a third Temporary Skill Shortage subclass 482 visa in the short stream needs to be lodged offshore

NEW: Under the proposed changes, a limit on the number of short-stream TSS applications that the 482 subclass visa holders can lodge will be removed. Short-term stream TSS visa holders with visas expiring before 25th November 2023 will still need to travel outside Australia to lodge their third short-term stream TSS Visa.

NEW: In the proposed changes, a subclass 482 holder in the medium-term stream will only need to hold their 482 visa for 2 years before they become eligible to be nominated by their employer for a subclass 186 permanent visa in the TRT stream.

CURRENT: Currently, a subclass 482 visa holder in the short-term stream was not eligible to be nominated by their employer for a subclass 186 permanent residency visa in the TRT stream.

NEW: From 25th November, a subclass 482 visa holder in the short stream will be able to be nominated by their employer for a 186 visa TRT stream if they have held a 482 visa for 2 years with the same employer. Employers will now be able to nominate all TSS holders for permanent residency including Medium-term, short-term, and labour streams.

There are more changes to the subclass 186 TRT stream Visa Applications:

  1. Age exemptions for regional medical practitioners’ prospects and high-earning individuals who are older than 45 years will be modified to facilitate a more streamlined 2-year permanent visa pathway.
  2. All age-related exemptions which were COVID-19 related, will be phased out due to the new changes which have been brought under this two-year pathway to permanent residency.

These new changes which will come into effect on 25th November 2023 will benefit employers who were affected when their employees on 482 visas had to travel offshore to submit a new TSS visa causing disruption and inconvenience increasing productivity. It will also help employees on subclass 482 Temporary Skill Shortage Visa who had to leave Australia causing inconvenience and insecurity, to continue to work without affecting their life. These migration reforms to the subclass 482 TSS were long overdue and the Australian government by bringing these reforms has tried to solve the skilled shortage issues affecting the employers.
